Creative Search Technologies (Private) Limited, a company registered in Sri Lanka and operating under VAT No. PV60752 [hereinafter referred to as “BookLanka” / “We” / “Us” / “Our”], owns and operates the website “BookLanka.com” [the Website] as an Online Travel Agent (OTA).
The Website is operated for the sole purpose of assisting users who access the Website [“Users” / “You”] in searching, finding, and booking travel-related products including but not limited to adventure activities, safaris, tours, excursions, cultural experiences, accommodation, transfers, transport services, wellness experiences, and other travel-related services [collectively, “Products”], as well as pre-packaged or customizable itineraries [collectively, “Packages”] within Sri Lanka [the Service], and for no other purpose.
BookLanka provides the Service in collaboration with independent local suppliers and third-party partners who are individually responsible for delivering the respective Products and Packages. Users may access the Website and make use of the Service in agreement with these Terms and Conditions.
1.0 The Agreement
1.1 Parties to the Agreement
The Products and Packages available through the Service are provided by independent third-party suppliers [“Providers”] over whom BookLanka has no direct operational control and in whom BookLanka holds no ownership interest.
Payments are made through the BookLanka.com Website, and BookLanka remains a contractual party to your booking. Any requests relating to cancellations, amendments, rebookings, or inquiries must be made via BookLanka.com or by contacting our customer support team.
1.2 Acceptance of the Agreement
By accessing or using the Website, you acknowledge that you have read, understood, and accepted these Terms and Conditions and agree to be legally bound by them. We advise you to read this Agreement carefully to understand your rights and obligations.
1.3 Updates to the Agreement
We reserve the right to update or modify these Terms and Conditions at any time. Where appropriate, we will notify Users of material changes via the Website or by email using the contact details registered to your account.
1.4 Provider Terms and Conditions
Additional terms and conditions imposed by individual Providers may apply and will be made available to you prior to or after booking.
By completing a booking, you agree to both BookLanka’s Terms and Conditions and the relevant Provider’s Terms and Conditions. In the event of a conflict, BookLanka’s Terms and Conditions shall prevail, subject to applicable law.
This Agreement constitutes the entire agreement between you and BookLanka.
2.0 The Website
2.1 Proprietary Content
All intellectual property rights related to the Website, including but not limited to trademarks, copyrights, software, text, images, videos, data, designs, and other materials [collectively, “Content”], are owned by or licensed to BookLanka.
You acquire no ownership rights in the Content. Unauthorized use of the Content is strictly prohibited.
2.2 Website Use
The Website is provided for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, resell, scrape, or commercially exploit any Content without prior written consent from BookLanka.
You agree not to:
Use the Website for unlawful purposes
Attempt unauthorized access to systems or data
Introduce malicious software
Interfere with Website functionality or security
We reserve the right to restrict or terminate access to the Website at our discretion.
3.0 The Service
3.1 Target Audience
The Service is intended for both domestic and international travelers booking travel services within Sri Lanka. Users accessing the Website from outside Sri Lanka do so at their own initiative and are responsible for compliance with local laws.
3.2 Availability & Booking Confirmation
Information on the Website does not constitute a binding offer. Availability and pricing are only confirmed once you receive a booking confirmation from BookLanka.
3.3 Prices
Unless otherwise stated, prices are displayed per person or per booking unit. Prices may change until a booking is confirmed.
Prices exclude taxes, insurance, gratuities, visa fees, and other costs unless explicitly stated.
3.4 Accuracy of Information
While we strive to ensure accuracy, BookLanka does not guarantee the completeness or correctness of all information displayed. We reserve the right to correct errors and will notify you if changes affect your booking.
Our liability, where applicable, is limited to the amount paid for the affected Product.
3.5 Provider Responsibility
BookLanka acts solely as an intermediary. Providers are responsible for delivering Products in accordance with their terms and applicable laws.
BookLanka is not liable for acts, omissions, or failures of Providers.
3.6 Booking Confirmation
You must present your booking confirmation and valid identification when redeeming a Product. Failure to do so may result in denial of service.
3.7 Gift Vouchers
Gift vouchers are non-refundable, non-transferable, and valid for the period specified at the time of issue. They may only be redeemed on BookLanka.com.
4.0 Liability
4.1 Limitation of Liability
You acknowledge that travel and adventure activities carry inherent risks. BookLanka shall not be liable for injury, loss, damage, delay, or inconvenience unless caused by gross negligence or willful misconduct.
Any liability is limited to the amount paid for the affected booking.
4.2 Personal Data & Privacy
Your personal data is handled in accordance with our Privacy Policy, which forms part of this Agreement.
5.0 Your Responsibilities
5.1 Booking Accuracy
You confirm that you are at least 18 years old and authorized to make bookings. You agree to provide accurate information at all times.
5.2 Accounts
You are responsible for maintaining the confidentiality of your account credentials. BookLanka is not liable for unauthorized use of your account.
5.3 Conduct
You agree to comply with Provider rules and local regulations. Disruptive behavior may result in cancellation without refund.
5.4 Complaints
Complaints must be reported to BookLanka within 24 hours of the incident. We must be given the opportunity to resolve the issue before any claims are made.
6.0 Payments, Cancellations & Changes
6.1 Payment
Payments are made through BookLanka.com using accepted payment methods. Full payment is required at the time of booking.
6.2 Cancellations by You
Cancellation policies vary by Product and Provider. The applicable policy will be displayed at the time of booking.
6.3 Cancellations by Us
We reserve the right to cancel bookings due to operational or safety reasons. In such cases, refunds or alternatives will be offered.
6.4 Amendments
All booking changes must be requested through BookLanka. Fees or price differences may apply.
7.0 Travel Documents & Insurance
You are responsible for ensuring you meet entry requirements and for obtaining appropriate travel insurance.
8.0 Force Majeure
We are not liable for events beyond our reasonable control, including natural disasters, government actions, or other unforeseen circumstances.
9.0 Termination
We may terminate access to the Website or Service if you breach these Terms and Conditions.
10.0 Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of Sri Lanka.
